BE TAXI – Terms and Conditions

  1. CUSTOMER TERMS OF SERVICE

    1. Booking and Payment

    1.1 Booking Process

    • All journeys must be booked through the BE TAXI mobile application.
    • BE TAXI acts as a booking and dispatch platform connecting customers with licensed Hackney Carriage drivers.
    • A booking is confirmed once accepted by a driver through the app.

    1.2 Fares

    • Fares are calculated based on time, distance, and location, in accordance with tariffs set by the relevant local licensing authority.
    • Final fares may vary due to traffic conditions, route changes, or passenger requests during the journey.

    1.3 Additional Charges

    • Airport and city drop-off charges may apply and will be added to the fare where applicable.
    • Congestion Charge, ULEZ, LEZ, tolls, or similar charges are the responsibility of the passenger.
    • Where such charges apply, the driver will notify you during the journey and the amount will be added to the total fare.
    • These additional charges must be paid to the driver.

    1.4 Payment Method

    • Payments are processed securely via the BE TAXI app.
    • Drivers do not accept cash unless permitted by local licensing rules.
    • All payments must be completed before leaving the vehicle.

    2. Promotions and Discounts

    • A 20% discount is available on the first completed ride only for new customers.
    • The discount applies only when payment is made by card through the BE TAXI app.
    • Promotions are non-transferable, have no cash value, and cannot be combined unless stated otherwise.
    • BE TAXI reserves the right to amend or withdraw promotions at any time without prior notice.

    3. Cancellations and Refunds

    3.1 Instant Bookings

    • You may cancel a booking within 5 minutes of confirmation for a full refund.
    • Cancellations made after 5 minutes may incur a cancellation fee to cover administration and driver allocation costs.
    • If the driver has arrived or the journey has started, no refund will be issued.
    • A no-show (failure to attend the pickup location within 5 minutes of driver arrival) will result in the full fare being charged.

    3.2 Scheduled (Advance) Bookings

    • Scheduled bookings may be cancelled up to 1 hour before the scheduled pickup time.
    • Late cancellations may incur a cancellation fee.

    3.3 Driver Cancellations

    • If a driver cancels a booking, BE TAXI will attempt to reallocate the journey.
    • BE TAXI shall not be responsible for any loss, cost, or inconvenience arising from driver cancellations.

    4. Passenger Conduct and Safety

    • Passengers must treat drivers with respect at all times.
    • Abusive, aggressive, threatening, or discriminatory behaviour will result in immediate service refusal and possible account suspension.
    • Smoking, vaping, alcohol consumption, or illegal substances are strictly prohibited in the vehicle.
    • Children under the age of 16 must be accompanied by an adult.
    • Child seats are not provided unless explicitly stated in the app.

    5. Customer Responsibilities

    5.1 Payments

    • All fares and additional charges must be paid in full.
    • Unpaid journeys may be reported to the police and may result in permanent account suspension.

    5.2 Vehicle Damage and Cleanliness

    • Customers are responsible for any damage caused to the vehicle during the journey.
    • Cleaning fees will be charged for excessive mess, sickness, or contamination of the vehicle.

    6. Delays, Accidents, and Liability

    6.1 Delays

    • Arrival and journey times are estimates only.
    • BE TAXI is not responsible for delays caused by traffic, weather, road closures, or other external factors.
    • Customers are responsible for allowing sufficient travel time.

    6.2 Accidents

    • All drivers are required to hold valid insurance in accordance with UK licensing requirements.
    • In the event of an accident, claims must be made directly against the driver’s insurer.
    • BE TAXI is not liable for losses arising during the journey.

    7. Equality and Accessibility

    • BE TAXI operates in accordance with the Equality Act 2010.
    • Discrimination on the grounds of disability, race, religion, gender, sexual orientation, or any protected characteristic is not tolerated.
    • Assistance dogs are permitted in accordance with UK law.

    8. Lost Property

    • BE TAXI is not responsible for items left in vehicles.
    • Reasonable efforts will be made to assist with recovery, but recovery is not guaranteed.
    • Any costs incurred in returning lost property may be charged to the customer.

    9. Data Protection and Privacy

    • BE TAXI processes personal data in accordance with the UK GDPR and the Data Protection Act 2018.
    • Personal data is used only for booking, payment, safety, and service improvement purposes.

    10. Complaints and Dispute Resolution

    • Complaints should first be raised through BE TAXI’s internal complaints process by emailing contact@betaximk.com. We aim to respond within 24 hours.
    • If unresolved, complaints may be escalated to the relevant local licensing authority.
    • These Terms are governed by the laws of England and Wales and subject to the courts of England and Wales.

    11. Limitation of Liability

    • BE TAXI shall not be liable for indirect, incidental, or consequential losses.
    • Drivers are independent operators and are individually responsible for licensing, insurance, and road safety compliance.

    12. Amendments

    • BE TAXI reserves the right to update these Terms at any time.
    • Changes will be communicated via the app or official communication channels.

    13. Severability

    • If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    14. Entire Agreement

    These Terms constitute the entire agreement between BE TAXI, drivers, and customers and supersede all prior agreements or understandings.

  2. DRIVER TERMS AND CONDITIONS

    1. Driver Status

    • Drivers using the BE TAXI platform are self-employed independent contractors and are not employees, workers, agents, or partners of BE TAXI.
    • Drivers operate under their own Hackney Carriage licence issued by their local licensing authority.
    • Nothing in these Terms creates an employment relationship.

    2. Driver Responsibilities

    2.1 Licensing & Legal Compliance

    • Hold a valid Hackney Carriage Driver Licence and vehicle licence at all times.
    • Comply with all local authority by-laws, conditions, inspections, and enforcement requirements.
    • Maintain valid motor insurance covering hackney carriage/private hire use.
    • Maintain a valid MOT, road tax, and all required vehicle safety certificates.
    • Hold a valid right to work in the UK and provide evidence upon request.
    • Immediately notify BE TAXI of suspension, revocation, or investigation relating to their licence.

    Any breach may be:

    • Reported to the local licensing authority, and/or
    • Reported to the police, where required by law.

    2.2 Scheduled Rides

    • Drivers must complete pre-booked or scheduled rides once accepted.
    • If a genuine emergency prevents completion, BE TAXI admin must be notified at least one (1) hour in advance, where possible.
    • Repeated failure to complete scheduled rides may result in account suspension.

    3. Payments, Fees & Commission

    3.1 Passenger Payments

    • BE TAXI processes passenger payments and distributes driver earnings according to its payment schedule.
    • BE TAXI is not responsible for declined payments, unpaid journeys, or failed transactions.

    3.2 Unpaid Journeys

    • In the event of a cash journey where the passenger fails to pay, the driver must report the matter directly to the police.
    • Where BE TAXI is notified of an unpaid journey, the passenger’s account will be permanently blocked.
    • BE TAXI accepts no liability for driver losses resulting from unpaid fares.

    3.3 Commission & Earnings

    • Any commission owed to BE TAXI must clear by the following Tuesday.
    • Driver earnings credited by BE TAXI will be paid every Wednesday.
    • Promotional offers (e.g. 0% commission) allow drivers to retain 100% of the fare excluding third-party processing fees.
    • Promotions may be withdrawn or amended at any time.
    • Drivers will be given reasonable notice of permanent commission changes.

    3.4 Meter Fares

    • App fares are estimates only.
    • Drivers must use the official taxi meter during all journeys.
    • The meter fare is the final charge.

    4. Charges & Additional Fees

    • Airport pickup/drop-off charges
    • Congestion Charge
    • ULEZ charges
    • Any other legally applicable local charges
    • BE TAXI is not responsible if drivers fail to collect these charges.

    5. Driver Conduct & Standards

    • Act professionally, courteously, and respectfully at all times.
    • Maintain a clean, roadworthy vehicle.
    • Display all required plates, badges, and licences.
    • Use their taxi roof sign at all times when logged into the BE TAXI app.
    • Avoid unsafe, abusive, threatening, or discriminatory behaviour.

    The following may result in suspension or permanent removal:

    • Rudeness or misconduct
    • Unsafe driving
    • Discrimination (Equality Act 2010)
    • Repeated cancellations or refusal of reasonable jobs

    6. Equality, Accessibility & Assistance Dogs

    • Drivers must not refuse passengers with guide dogs or assistance dogs.
    • Drivers must not refuse passengers with wheelchairs or special access needs.
    • Once a ride is accepted, it must not be refused upon arrival.
    • Breaches may be reported to the local council enforcement team.

    7. Vehicle Cleanliness & Damage

    • Cleaning fees for sickness or mess may be charged in line with council-approved rates.
    • Any vehicle damage must be resolved directly between driver and passenger.
    • BE TAXI accepts no responsibility for losses or damage caused by passengers.

    8. Use of the BE TAXI Driver App

    • Keep their profile active and documents up to date.
    • Only accept rides when fit, healthy, and capable of driving safely.
    • Not accept rides if unwell, fatigued, or vehicle is unroadworthy.
    • Not accept rides if any licence or document has expired.
    • Submit updated documents before continuing to accept rides.

    Driver accounts are:

    • Strictly personal
    • Not transferable
    • Sharing accounts will result in permanent blocking and reporting to local authorities.

    9. Tax & VAT

    • Drivers are fully responsible for declaring and paying income tax.
    • Drivers are fully responsible for declaring and paying National Insurance.
    • Drivers are fully responsible for declaring and paying VAT (if registered).
    • All fares exclude VAT.
    • VAT-registered drivers must add VAT to the actual fare and account for it themselves.

    10. Data Protection & Privacy

    • Drivers consent to processing of personal data for app functionality.
    • Drivers consent to processing of personal data for payments and legal compliance.
    • Customer data must not be misused, shared, or accessed outside BE TAXI systems.
    • Breaches may result in termination and legal action under UK GDPR.

    11. Complaints & Enforcement

    • BE TAXI investigates all complaints seriously and fairly.
    • Where required, matters may be reported to local council enforcement or police.
    • Drivers must cooperate fully with investigations.

    12. Suspension & Termination

    • Licence breaches
    • Safety concerns
    • Fraud or misuse of the app
    • Serious misconduct
    • Legal or regulatory requirements

    13. Limitation of Liability

    • BE TAXI is not liable for driver income loss.
    • BE TAXI is not liable for unpaid fares.
    • BE TAXI is not liable for passenger misconduct.
    • BE TAXI is not liable for vehicle damage.
    • Nothing in these Terms limits liability where prohibited by law.

    14. Changes to Terms

    • BE TAXI may amend these Terms at any time.
    • Significant changes will be notified via the app or email.
    • Continued use constitutes acceptance.

    15. Governing Law

    These Terms are governed by the laws of England and Wales.

  3. GENERAL TERMS (APPLIES TO ALL USERS)

    • BE TAXI reserves the right to modify these Terms at any time. Notice of significant changes will be provided via the app or by email.
    • Continued use of BE TAXI services after changes are made constitutes acceptance of the revised Terms.
    • These Terms are governed by the laws of England and Wales.
